Terms of Service

1. Acceptance of Terms

By downloading, installing, or using BeamOut (the "Game") or visiting the BeamOut website at beamout.me (the "Website", and together with the Game, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

BeamOut is a mobile arcade game developed by RobotHead LTD. The Service includes:

• The BeamOut mobile game application for Android and iOS
• Public leaderboards displaying player scores (all-time, monthly, and weekly rankings)
• Server-side replay validation to ensure score integrity
• Video replay rendering and hosting on the Website
• Push notifications about replay processing and score validation

3. Account & Authentication

To access certain features of the Service (such as leaderboards and replay sharing), you must sign in through Google Play Games Services (Android) or Apple Game Center (iOS). You are responsible for:

• Maintaining the security of your platform account
• All activity that occurs under your account
• Ensuring your display name complies with Section 4 of these Terms

We do not create separate accounts. Your identity is derived from your gaming platform account.

4. User Conduct

You agree not to:

• Cheat, hack, or exploit bugs in the Game
• Use automated scripts, bots, or modified game clients to play the Game
• Manipulate, falsify, or tamper with gameplay data, replay recordings, or scores
• Attempt to bypass replay validation or device attestation mechanisms
• Engage in seed grinding or other techniques designed to gain unfair advantage
• Use offensive, inappropriate, misleading, or impersonating display names
• Attempt to disrupt, overload, or interfere with the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the Game or Service
• Circumvent rate limits, access controls, or other security measures

5. Leaderboards and Replays

By using the Service, you acknowledge and agree that:

• Your validated scores will appear on publicly visible leaderboards alongside your display name, avatar, and platform
• When you choose to share a replay, your gameplay will be re-rendered server-side into a video
• Video replays are publicly visible on the Website and display your display name, avatar, and score
• Video replays can be viewed, shared, and downloaded by any visitor to the Website
• You grant RobotHead LTD a worldwide, royalty-free, non-exclusive license to host, display, distribute, and reproduce your replay videos for the purposes of operating the Service
• Video replays are automatically deleted after a retention period (typically 30 days)
• Weekly and monthly leaderboard entries expire automatically; all-time entries are retained indefinitely

6. Score Validation & Anti-Cheat

To maintain fair competition:

• All submitted scores are validated by replaying your game session on our servers
• We may verify your device and app integrity via Google Play Integrity (Android) or Apple App Attest (iOS)
• We monitor for patterns of abuse, including excessive token requests and seed grinding
• Display names are subject to automated content moderation

We reserve the right to invalidate, remove, or adjust any score that we determine, in our sole discretion, was achieved through cheating, exploitation, or manipulation. We may also ban accounts that violate these Terms, which removes all associated leaderboard entries and video replays.

7. Advertisements

The Game displays advertisements through Google AdMob, including interstitial ads between games and rewarded ads that grant in-game benefits (such as an extra life, score validation, or replay sharing). Viewing rewarded ads is optional. You may not use ad-blocking tools or techniques to circumvent advertisements within the Game.

8. Intellectual Property

The Game, Website, and all content therein — including but not limited to graphics, audio, music, shaders, code, game design, and visual identity — are owned by RobotHead LTD and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works without our express written permission. Video replays generated by the Service may be shared freely for personal, non-commercial purposes. RobotHead LTD reserves the right to use replay videos for promotional and marketing purposes.

9. Third-Party Services

The Service integrates with third-party platforms and services, including:

• Google Play Games Services (Android authentication and player profiles)
• Apple Game Center (iOS authentication and player profiles)
• Google Play Integrity API (Android device attestation)
• Apple App Attest (iOS device attestation)
• Google AdMob (in-game advertisements)
• Firebase Cloud Messaging (push notifications)

Your use of these services is subject to their respective terms and conditions. We are not responsible for the practices or content of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. LEADERBOARD RANKINGS, SCORES, AND VIDEO REPLAYS MAY BE SUBJECT TO DELAYS, ERRORS, OR REMOVAL WITHOUT NOTICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROBOTHEAD LTD, ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF SCORES, OR REMOVAL OF LEADERBOARD ENTRIES.

12. Termination & Bans

We reserve the right to terminate or suspend your access to the Service at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Cheating or manipulation of scores
• Use of offensive or inappropriate display names
• Abusive behavior or excessive API usage

Banned accounts will have their leaderboard entries and video replays removed. Bans may be temporary or permanent at our sole discretion.

13. Changes to Terms

We may modify these Terms at any time by posting the revised version on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Romania. Any disputes arising out of or in connection with these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Bucharest, Romania.
